It's once again time to review the winners of the annual Stella awards.

The Stellas are named after 81 year old Stella Liebeck who spilled

coffee on herself and successfully sued McDonald's. That case inspired the

Stella

Awards for the most frivolous successful lawsuits in the United States.



Unfortunately the most recent lawsuit implicating McDonald's, the teens

who allege that eating at McDonald's has made them fat, was filed after

the 2002 award voting was closed. This suit will top the 2003 awards

list without question.



5th Place (Tied) - Kathleen Robertson of Austin, Texas, was awarded

$780,000 by a jury of her peers after breaking her ankle tripping over a

toddler who was running inside a furniture store. The owners of the

store were understandably surprised at the verdict, considering the

misbehaving toddler was Ms Robertson's Son.



5th Place (Tied) - 19 year old Carl Truman of Los Angeles won $74,000

and medical expenses when his neighbor ran over his hand with a Honda

Accord. Mr. Truman apparently did not notice there was someone at the

wheel of the car when he was trying to steal the hubcaps.

5th Place (Tied) - Terrence Dickson of Bristol, Pennsylvania, was

leaving a house he had just finished robbing by way of the garage. He

was not able to get the garage door to go up since the automatic door

opener was malfunctioning. He could not re-enter the house because the

door

connecting the house and garage locked when he pulled it shut. The

family was on vacation and Mr. Dickson found himself locked in the garage

for 8 days.

He subsisted on a case of Pepsi he found and a large bag of dry dog

food. He sued the homeowner's insurance claiming the situation caused

him undue mental anguish. The Jury agreed to the tune of $500,000.



4th Place - Jerry Williams of Little Rock, Arkansas, was awarded $14,500

and medical expenses after being bitten on the buttocks by his next door

neighbor's Beagle dog. The Beagle was on a chain in its owner's fenced

yard. The award was less than sought because the jury felt the dog might

have been a little provoked at the time as Mr. Williams who had climbed

over the fence into the yard was shooting it repeatedly with a pellet gun.



3rd Place - A Philadelphia restaurant was ordered to pay Amber Carson

of Lancaster, Pennsylvania, $113,500 after she slipped on a soft drink

and broke her coccyx (tailbone). The beverage was on the floor because

Ms. Carson had thrown it at her boyfriend 30 seconds earlier during an

argument.



2nd Place - Kara Walton of Claymont, Delaware, sued the owner of a Night

Club in a neighboring city when she fell from the bathroom window to the

floor and knocked out two of her front teeth. This occurred whilst Ms.

Walton was trying to sneak out of the window in the Ladies Room to avoid

paying the $3.50 cover charge. She was awarded $12,000 and dental

expenses.



1st Place - This year's runaway winner was Mr. Merv Grazinski of

Oklahoma City, Oklahoma. Mr. Grazinski purchased a brand new Winnebago

Motor Home. On his trip home from an OU football game, having driven

onto the Freeway, he set the cruise control at 70 mph and calmly left

the drivers seat to go into the back and make himself a cup of coffee. Not

surprisingly the RV left the Freeway, crashed and overturned. Mr.

Grazinski sued

Winnebago for not advising him in the owner's manual that he could not

actually do this. The jury awarded him $1,750,000 plus a new Winnebago

Motor Home.

The company actually changed their manuals on the basis of this suit just

in

case there were any other complete morons buying their recreation

vehicles.

ashok anne,
the above ones are fabricated. though you must have heard about
fairly weird cases/rulings these days.

yes. mcdonalds once was ruled by a court to pay money to their customer
who spill coffee (all by herself) on her and had skin burnt by the hot liquid. :?
so such cases do happen though not so frequently as the above :P

so the next time you get into a department store dont enact tripping and
falling and try to sue those stores :P

See, you believed the story when told in convincing manner, while Vennai did the fact finding. The moment I read it, I knew it is a hoax. I know US is known for law suits, but not like this.

But I dont understand, how does this make life in the US good? It sucks big time, except for a few comforts..

iyanaar, yes you are correct. these kind of weird rulings are not the norm
even here in usa. every month we get a list of out of ordinary rulings.
and they said that most of these rulings are from the western states ca,or
and wa. donno why that is the trend :?

hmm but won't you agree that the US sees far more of these kind of suits than anywhere else....but it does seem to be spreading accross the ocean...just like everything else...

well I guess life is soo good that you get sued for the slightest thing :Ksp:

The tort law system is US is too screwed up, Blue. In fact tort law as applied to healthcare is one of the hot topics in the US presidential debates this year... Protecting rights of consumers and public, while plugging the loopholes for such frivolous suits is a constant challenge for law makers..

One reason it does not work in other countries..? Laws are not really supportive of such suits.. You will get nothing, if you sue some one in India.. :) (which is also bad, because, people can get away with anything.. difficult to keep them accountable..)

are you kidding me? :00: life sucks.. These stupid law suits makes every one's health insurance, liablility insurance, car insurance and everything else under the sun go sky rocketing.. Doctors spend as much as 100 K in insurance - and ofcourse they charge back in their fees. And insurance companies simply hike up everyone's rates.. Its a vicious circle, really..

Life is good only for the tort lawyers.. (Read the John Grisham's King of Torts.. for a fictional, but not too much different from truth view on this.. )..

oh they can ...but I guess our barristers are still a bit on the conservative side to accept them :wink:

hmm yes ... it is quite difficult I suppose to strike the right balance :think:

mind you I thought those ppl suing McD for making them fat ...was a kind of rather silly :? if you eat too much fatty food it is to be expected that you get fat....logical...

Hey, none of this has anything to do with my career change plan to be a Lawyer. :ahha: :ahha:

Dont even talk about legal system in India. Only high profile cases get judicial attention. Not every one can get a supreme court lawyer. Life at the lower level courts is extremely corrupt and time consuming that only insane person would try to wage a legal battle. I wanted to sign up a power of attorney document which took three days of my time running around various registrar offices which eventually happened after I approached a lawyer who bribed the right people and got the job done in 30 minutes.

I too agree.. Life here is boring and dull... Insurance companies.. jolliya kuthu adichitu irrukanga.. Nimathiya yarayum iddika mudiya matenguthu.. Enna solla.. peru thaan America.. ulla ellam berrika thaan.

life in the US is amazin, no doubt. though...to live here properly u gotta spend money in almost every single direction...can get frustrating at times...but worth it!!
